The Council of the City of Mobile, Alabama, met in the City Council’s Conference Room on the ninth floor of the Mobile Government Plaza on Wednesday, May 24, 2017, at 9:00 a.m.

The meeting was called to order. The Council reviewed and discussed the agenda for their meeting to be held today at 10:30 a.m.

The City Council of the City of Mobile, Alabama, met in the Auditorium of the Mobile Government Plaza on Wednesday, May 24, 2017, at 10:30 a.m., in regular meeting.

The meeting was called to order by City Clerk Lisa Lambert.

Father Ken C. Ugwu, Most Pure Heart of Mary Catholic Church, offered an invocation.

The Presiding Officer led the Pledge of Allegiance.

Councilmember Gregory asked everyone to remain standing for a moment of silence in observance of the passing of Assistant City Clerk Mary Ann Merchant’s nephew, as well as the victims of the bombing in Manchester, England.

Councilmember Gregory noted:
1. The swearing in ceremony for Mobile Fire-Rescue Chief Mark Sealy will take place Tuesday, May 30, 2017, 10:00 a.m., in the Ceremonial Courtroom.
2. The next off-site City Council meeting will be held Tuesday, June 27, 2017, 6:00 p.m., at Burroughs Elementary School.

STATEMENT OF RULES BY COUNCIL PRESIDENT:

The Presiding Officer stated that all cell phones must be turned off and that there will be no hats, hoods, sunglasses or large bags permitted in the meeting room.

1) Any person desiring to address the Council must register upon entering the meeting area. When addressing the Council, the speaker must state his/her name and address.

2) Each speaker is allowed five minutes to address the Council. A bell will sound to indicate the end of 4 minutes. One minute is allowed for summarizing. The second bell indicates the time has expired.

3) To maintain decorum, there will be no undue applause and/or public outcry allowed.

4) When addressing the Council, there is to be no personal address to any individual Councilmember. All statements are to be made to the Chair who will recognize any Councilmember who wishes to respond.

5) Any person desiring to speak to the Council on a non-agenda item must contact the City Clerk's Office no later than 2:00 p.m. on the Thursday prior to the Council Meeting. The subject he/she wishes to address must be identified. Any person attending the meeting who has not given proper notice to the Clerk's Office and wishes to speak on a non-agenda item will not be allowed to address the Council.

6) Those persons desiring to speak on agenda items must indicate the resolution, ordinance, appeal, or public hearing item on arrival when signing in for the meeting.

APPROVAL OF MINUTES:

The minutes of the meeting of May 16, 2017 were approved as submitted.

COMMUNICATIONS FROM THE MAYOR:

Mayor Stimpson read a proclamation honoring Assistant Fire Chief William “Billy” Pappas’ thirty-one years of service with the Mobile Fire-Rescue Department.

Mayor Stimpson rebutted claims made by Uber that the City is blocking legislation that would set up a statewide regulatory system for ride-sharing services.

Mayor Stimpson expressed his hopes that the Mobile Police Department’s Second Precinct new location in Tillman’s Corner will be complete in July.

Mayor Stimpson announced the City will be partnering with the Mobile County Public School System and Baldwin County for the YES initiative to offer youth employment opportunities in the hospitality industry.

MONTHLY FINANCE REPORT:

Executive Director of Finance Paul Wesch:

“Good morning. There is a City Council Finance Committee meeting this afternoon, so I won’t labor you with statistics, facts and figures this morning; rather I would like to thank you for standing together, for standing with our Mayor and for your engagement with our legislative delegation through this regular session that the Mayor just touched on.”

“In addition to the Uber challenge, which was an attempt to impair the jurisdictional prerogatives of the City, we had a number of other challenges that were financial in nature. We had a gas tax that, with your help, we tried to make the legislation as tolerable as we could, but in the final analysis it was a bad bill and it did die. For a while we had a chance of forever having a second position when it comes to tax revenue.”

“There was a prescription drugs bill that would have relieved smaller pharmacies from having to pay business licenses like all other businesses have to do. This sounded like an attempt to do good by relieving people who depend upon medications from having to pay additional costs, but it was a thinly veiled attempt by members of the legislation, who happen to own drug stores, to relieve themselves of the liability for paying business license fees and to put them into a position of superiority over their peers.”

“We also had bills that sought to do away with portions of lodging taxes, rights-of-way fees and home health care fees and all of these failed, but in defending those it really took the efforts of the Council and the Mayor, so thank you very much for that.”

“There is one other resolution on the agenda that touches on the annual levy. This is important this year because for the first time this extends the ad valorem tax imposition from the City into the 2007 annexation along Schillinger Road. It will result in about a $395 thousand additional revenue source for the City. Next year that same thing will happen with the Tillman’s Corner 2008 annexation. Thank you for supporting that. I will be happy to answer any questions.”

ADOPTION OF THE AGENDA:

Councilmember Richardson moved to amend the agenda by moving the “Presentation of Petitions and Other Communications to the Council” to the beginning of the agenda, which motion was seconded by Councilmember Rich and the vote was as follows:

Ayes: Richardson, Manzie, Small, Williams, Daves, Rich and Gregory
Nays: None

The vote was then announced by the City Clerk whereupon the Presiding Officer declared the agenda amended.

Councilmember Small moved to adopt the agenda as amended, which motion was seconded by Councilmember Williams and the vote was as follows:

Ayes: Richardson, Manzie, Small, Williams, Daves, Rich and Gregory
Nays: None

The vote was then announced by the City Clerk whereupon the Presiding Officer declared the agenda adopted as amended.

PRESENTATION OF PETITIONS AND OTHER COMMUNICATIONS TO THE COUNCIL:

AGENDA ITEMS:

Appeal of the Planning Commission’s approval of St. Luke’s Episcopal School’s application for a Planned Unit Development to allow multiple buildings on a single building site and Planning Approval for new lighting, sound system and bleachers for the athletic area.

The following persons spoke in favor of the appeal:

Mary Ann Robinson stated for the record:

“This case has been tainted from the very beginning, from 2009 all the way up until the present. A conflict interest has existed between St. Luke’s, Mr. Rossler, Mr. Anderson, the Planning Commission and the City Council. Even if someone were to recuse him or herself at this point it is too late. The influence is already there.”

“In 2009 the opposing homeowners entered into an agreement with St. Luke’s and reached a settlement. In return for withdrawing their objective for the PUD application they were given the right to maintain the buffer area. Regardless of how small it is, it does help to block some of the sound. Yet presently they assigned that right to do whatever they wanted to do with that buffer to homeowners that purchased their houses after 2009 and were not party to that agreement. I am not blaming those homeowners, they may not have even known about that, but they gave them permission to do whatever they wanted; take down the fence if they want, cut back what has been growing that we chose to consider as maintained by continuing allowing it to grow. That contract has been breached.”

“St. Luke’s PUD application is clearly violating the noise ordinance. It is the City Council’s responsibility to uphold their own ordinances and therefore it does not have the authority to allow the pending applications to be approved. I think that after spending so much time on the noise ordinance last week our pleas were still not heard because when you watch the Mobile Christian Planning Commission meeting; which we were constantly being referred to as a case, I think the Planning Commission is still unclear on the meaning of arbitrary. They kept trying to say we were trying to be equal in regard to what they gave them and what was being done in this case. We are not trying to be equal; we are trying to follow the law, the laws that were established by the City. I want that on the record if you do not consider Mr. Shaw’s proposal then I would like for you to take all of that into consideration. Thank you.”

NON-AGENDA ITEMS:

Irene Antone, 2202 Clinton Street, presented her “Good Shepard” report to the Council.

Lucy Smith, 522 Osage Street, and Andrew Oliver, California, approached the Council with their concerns regarding the condition of Oaklawn Cemetery.

At approximately 10:56 a.m. Councilmember Gregory excused herself from the meeting.

At approximately 11:00 a.m. Councilmember Gregory returned to the meeting.

APPEALS:

The Council considered the request of the appeal of the Planning Commission’s approval of St. Luke’s Episcopal School’s application for a Planned Unit Development to allow multiple buildings on a single building site and Planning Approval for new lighting, sound system and bleachers for the athletic area.

Councilmember Williams moved to deny the appeal, which motion was seconded by Councilmember Rich, and the vote was as follows:

Ayes: Richardson, Manzie, Small, Williams, Daves, Rich and Gregory
Nays: None

The vote was then announced by the City Clerk, whereupon the Presiding Officer declared the appeal denied.

PUBLIC HEARINGS:

PUBLIC HEARING TO REZONE PROPERTY AT 108 AND 114 CENTER STREET, AND 75, 79, 113, 123 AND 129 WEST DRIVE (EAST SIDE OF WEST DRIVE, 120’ ± SOUTH OF OLD SHELL ROAD) FROM R-1 TO R-3 (DISTRICT 6).

The Presiding Officer announced that today was the day for the public hearing to rezone property at 108 and 114 Center Street, and 75, 79, 113, 123 and 129 West drive and asked if there was anyone present to speak for or against this matter.

The following persons spoke in favor of the rezoning:

PUBLIC HEARING TO DETERMINE IF THE STRUCTURE AT 755 MARINE STREET IS A PUBLIC NUISANCE AND ORDER IT REPAIRED OR DEMOLISHED (DISTRICT 3).

The Presiding Officer announced that today was the day for the public hearing to determine if the structure at 755 Marine Street is a public nuisance and order it repaired or demolished and asked if there was anyone present to speak for or against this matter.

No one appeared.

The Presiding Officer declared the hearing concluded and that the necessary resolution authorizing the proper action would be introduced later in the meeting.

PUBLIC HEARING TO DETERMINE IF THE STRUCTURE AT 704 SOUTH CAROLINA STREET IS A PUBLIC NUISANCE AND ORDER IT REPAIRED OR DEMOLISHED (DISTRICT 3).

The Presiding Officer announced that today was the day for the public hearing to determine if the structure at 704 South Carolina Street is a public nuisance and order it repaired or demolished and asked if there was anyone present to speak for or against this matter.

No one appeared.

The Presiding Officer declared the hearing concluded and that the necessary resolution authorizing the proper action would be introduced later in the meeting.

PUBLIC HEARING TO DETERMINE IF THE STRUCTURE AT 761 MARINE STREET IS A PUBLIC NUISANCE AND ORDER IT REPAIRED OR DEMOLISHED (DISTRICT 3).

The Presiding Officer announced that today was the day for the public hearing to determine if the structure at 761 Marine Street is a public nuisance and order it repaired or demolished and asked if there was anyone present to speak for or against this matter.

No one appeared.

The Presiding Officer declared the hearing concluded and that the necessary resolution authorizing the proper action would be introduced later in the meeting.

PUBLIC HEARING TO DETERMINE IF THE STRUCTURE AT 7375 KIM AVENUE IS A PUBLIC NUISANCE AND ORDER IT REPAIRED OR DEMOLISHED (DISTRICT 3).

The Presiding Officer announced that today was the day for the public hearing to determine if the structure at 7375 Kim Avenue is a public nuisance and order it repaired or demolished and asked if there was anyone present to speak for or against this matter.

Jessie Graham, 7375 Kim Avenue, advised the Council he has obtained building permits and is working to repair the structure.

The Presiding Officer declared the hearing concluded and that the necessary resolution authorizing the proper action would be introduced later in the meeting.

PUBLIC HEARING TO ACCEPT PUBLIC COMMENTS ON THE PROPOSED APPLICATION FOR A TRANSPORTATION ALTERNATIVE PROGRAM (TAP) GRANT TO INCLUDE ADA COMPLIANT SIDEWALKS ALONG DAUPHIN ISLAND PARKWAY FROM THE SOUTH SIDE OF I-10 TO OLD MILITARY ROAD.

The Presiding Officer announced that today was the day for the public hearing to accept public comments on the proposed application for a TAP grant to include ADA compliant sidewalks along Dauphin Island Parkway and asked if there was anyone present to speak for or against this matter.

No one appeared.

The Presiding Officer declared the hearing concluded and that the necessary resolution authorizing the proper action would be introduced later in the meeting.

ORDINANCES HELD OVER:

REZONE PROPERTY AT 2165 AND 2167 OLD SHELL ROAD (SOUTH SIDE OF OLD SHELL ROAD AT THE SOUTHERN TERMINUS OF FRAZIER COURT) FROM R-1 TO R-2 (DISTRICT 1).

AN ORDINANCE AMENDING THE ORDINANCE ADOPTED BY THE BOARD OF COMMISSIONERS OF THE CITY OF MOBILE ON THE 16TH DAY OF MAY, 1967, SAID ORDINANCE BEING COMMONLY KNOWN AS THE ZONING ORDINANCE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOBILE AS FOLLOWS:

Section One: That the Ordinance commonly known as the Zoning Ordinance and adopted on May 16, 1967, together with the Zoning Map of the City of Mobile, 1967, be, and the same hereby is changed and altered in respect to that certain property in the City of Mobile, State of Alabama, described as follows to-wit:

LOT 1 OF THE PROPOSED OLD SHELL AT ASHLAND PLACE SUBDIVISION.

The classification of said property is hereby changed from R-1, Single-Family Residential District, to R-2, Two-Family District, and it shall hereafter be lawful to construct on such property any structures permitted by the Ordinance of May 16, 1967, commonly known as the Zoning Ordinance and to use said premises for any use permitted by the terms of said Ordinance in a R-2, Two-Family District, provided, however, that the plans for any structure or building sought to be erected on said property shall be in compliance with the building laws of the City of Mobile, and that any structure shall be approved by the Building Inspector of the City of Mobile, and that any such structure be erected only in compliance with such laws, including the requirements of said Zoning Ordinance of May 16, 1967, and further provided, however, that no lot or parcel of land herein above described shall be used for any use allowed in a R-2, Two-Family District, until all of the conditions set forth below have been complied with: 1) completion of the Subdivision process; 2) limited to an approved Planned Unit Development; and 3) full compliance with all municipal codes and ordinances.

Section Two: This Ordinance shall be in force and effect from and after its adoption and publication.

The ordinance was read by the City Clerk; whereupon Councilmember Richardson moved that the ordinance be adopted, which was seconded by Councilmember Daves, and the vote was as follows:

Ayes: Richardson, Manzie, Small, Williams, Daves, Rich and Gregory
Nays: None

The vote was then announced by the City Clerk, whereupon the Presiding Officer declared the ordinance adopted.

LEVY TAXES FOR TAX YEAR BEGINNING OCTOBER 1, 2017, ON ALL REAL AND PERSONAL PROPERTY AND INTANGIBLES WITHIN THE CORPORTATE LIMITS OF THE CITY OF MOBILE. The following ordinance was held over for one (1) week until the regular meeting of Wednesday, May 24, 2017.

AN ORDINANCE TO LEVY TAXES FOR THIS TAX YEAR BEGINNING OCTOBER 1, 2017, AND FOR SUCCESSIVE YEARS, ON ALL REAL AND PERSONAL PROPERTY AND INTANGIBLES LOCATED IN CERTAIN AREAS WITHIN THE CORPORATE LIMITS OF THE CITY OF MOBILE AND TO EXCEPT FROM SUCH TAXES OTHER AREAS WITHIN THE CORPORATE LIMITS OF THE CITY OF MOBILE.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MOBILE, ALABAMA, as follows:

SECTION 1: For the purpose of paying the expenses of the City Government, the Council of the City of Mobile does hereby lay, levy, and assess for the municipal tax year, beginning October 1, 2017, and for successive tax years, ad valorem taxes on all real and personal property and intangibles located within the corporate limits of the City of Mobile, including, without limitations, property situated in the following described areas within the corporate limits of the City of Mobile, and which may be subjected to municipal ad valorem taxes under the Constitution and Laws of the State of Alabama, viz.:

“A”

Commencing at the intersection of the west harbor line of Mobile River and the township line between Township 3 south and Township 4 south; thence eastwardly along said township line to the point where the same intersects the east shore line of Blakely Island on Polecat Bay; thence southwardly along the meanders of the said east shore line of Blakely Island and the north shore line of the Mobile Bay Bridge Causeway to a point on said north shore line of said Causeway where said shore line is intersected by the north-south Coordinate Line 336,000 of the Transverse Mercator Projection for Alabama west Zone as used officially on Maps of the Mobile Bay area by the United States Corps of Engineers; thence south along said coordinate line to the point of its intersection with the south boundary line of Township 4 south, thence westwardly along said township line between Township 4 south and Township 5 south to the point where the same intersects the north right-of-way line of the Louisville and Nashville Railroad; thence southwestwardly along the north right-of-way line of the Louisville and Nashville Railroad to the west bank of Dog River; thence northwestwardly along the west bank of Dog River to the north bank of Bolton Branch; thence northwestwardly along the north bank of Bolton Branch to the range line between Range 1 west and Range 2 west of the St. Stephens Meridian; thence due north along said range line to the southwest corner of Section 6, Township 4 south, Range 1 west of the St. Stephens Meridian; thence east along the south line of Section 6, and continue east along the south line of Section 5 of said Township 4 south, Range 1 west in a straight line to the southeast line of Alley No. 1 (Prichard Lane); thence northeastwardly along the south property line of Alley No. 1 (Prichard Lane) to the point where the same intersects the east property line of College Avenue; thence southeastwardly along the east and north property lines of College Avenue to the north property line of Sweeney's Lane; thence southwestwardly along the north property line of Sweeney's Lane to the west bank of Toulmin's Branch; thence southeastwardly along the west bank of Toulmin's Branch to a point directly west of the south boundary line to the City of Prichard; thence eastwardly, northwardly and eastwardly, along the boundary line of the City of Prichard to the southeast corner of the Craftview Court Subdivisions; thence directly eastwardly to the point of Intersection of the west boundary line of West Highlands Subdivision; thence northwardly along the west boundary line of West Highlands Subdivision to the north boundary line of said Subdivision; thence eastwardly along the north boundary line of said subdivision to the west right-of-way line of Telegraph Road; thence northwestwardly along said right-of-way line to the south right-of-way line of the Bay Bridge Road; thence eastwardly along said south right-of-way line to the east right-of-way line of the Southern Railroad; thence northwestwardly along the east right-of-way line of the Southern Railroad to the point where the same intersects the township line between Township 3 south and Township 4 south; and thence eastwardly to the point of beginning at the intersection of said township line and the west harbor line of Mobile River.

Commencing at the intersection of the south right-of-way line of Bay Bridge Road with the east right-of-way line of the Southern Railroad; run thence eastwardly along the south right-of-way line of said Bay Bridge Road to its intersection with the center line of Paper Mill Road projected south; run thence northwardly, northwestwardly and westwardly, along the center line of Paper Mill Road projected southwardly and the center line of Paper Mill Road to its intersection with the eastern city limits of Prichard; run thence southwardly and eastwardly along the City Limits of Prichard to the point of beginning.

Commencing at a point where the north line of Section 7, Township 4 south, Range 1 west intersects the east right-of-way line of Federal Interstate Highway 1-65 (Belt Line Highway); run thence east along the north line of Section 7 and Section 8, Township 4 south, Range 1 west to the east right-of-way line of Mobile Street; run thence northeastwardly along the east line of said Mobile Street and the east line of Prichard Avenue West to the Prichard city limits; run thence northwestwardly along the boundary lines between Mobile and Prichard to where the same intersects the southeast right-of-way line of Federal Interstate Highway 1-65 (Belt Line Highway); run thence southwestwardly along the south and east right-of-way line of said Federal Interstate Highway 1-65 to the point of beginning.

Commencing at the northeast corner of the northwest one-quarter of the northwest one-quarter of Section 34, Township 3 South, Range 1 West; thence run southwardly, eastwardly, southwardly, westwardly, and southwardly along the Mobile-Prichard city limits line to the north line of Paper Mill Road (Diaz Street); run thence eastward and southward along the north and east lines of Paper Mill Road to the line between Township 3 south and Township 4 south; run thence east along the line between Township 3 south and Township 4 south to the west bank of Mobile River; run thence northward along the west bank of Mobile River and Chickasaw Creek to the north line of Sections 34 and 35, Township 3 south, Range 1 west extended eastward; run thence west along the north line of Section 35 and 34, Township 3 south, Range 1 west to the point of beginning.

“E”

Commencing at the northwest corner of the northeast one-quarter of Section 1, Township 4 south, Range 2 west and run east along the north line of Section 1, Township 4 south, Range 2 west and Section 6, Township 4 south, Range 1 west, to the west line of Interstate Highway 1-65; run thence northeastward along the west line of Interstate Highway 1-65 to the West Prichard City Limits; run thence southward along the Prichard city limits to the east line of Interstate Highway 1-65; run thence southwestward along the east line of Interstate Highway 1-65 to the south line of Section 6, Township 4 south, Range 1 west; run thence west along the south line of Section 6, Township 4 south, Range 1 west, and Section 1, Township 4 south, Range 2 west to the southwest corner of the southeast one-quarter of Section 1, Township 4 south, Range 2 west; run thence north along the north-south centerline of Section 1, Township 4 south, Range 2 west to the point of beginning.

All portions of any of the territory heretofore described in this Section which was brought into the corporate limits of the City by an election held pursuant to Article 2, Chapter 5, Title 37 of the Code of Alabama 1940, as amended, within ten years next immediately preceding the adoption of this Ordinance and which at the time it was brought within the City was used or occupied as or as a part of a mining, manufacturing, or industrial plant or construction, or which is used or occupied as or as a part of a railroad or street railroad, or for any other quasi public use, and continues to be so used, and all property having a situs of such territory (but not including residences, dwelling houses, storehouses, commissaries, warehouses, or the land on which they are situated) shall be exempt from the taxes levied by this Ordinance for the tax year beginning October 1, 2017.
